Terms of Service
These Terms describe the basic rules for using SmartSelect, a B2B SaaS platform that helps manufacturers create public product configurators and receive structured lead submissions.
Use of the service
SmartSelect provides tools for manufacturers to build, publish, and manage guided product configurators. You may use the service only for lawful business purposes and in accordance with these Terms.
You are responsible for ensuring that your use of SmartSelect complies with laws and obligations that apply to your business, products, customers, and industry.
Accounts and access
You are responsible for the accuracy of account information, for maintaining the confidentiality of login credentials, and for activity that occurs under your account or workspace.
If you invite team members, you are responsible for assigning appropriate roles and removing access when it is no longer needed.
Configurator content and pricing
Manufacturers are responsible for all configurator content they create or publish, including product descriptions, questions, options, images, branding, recommendations, estimated pricing, final SKUs, and related claims.
SmartSelect does not verify manufacturer product data, pricing, availability, technical suitability, or quote accuracy. Public configurators should be reviewed before they are shared with customers.
Lead data and customer submissions
Public configurator submissions may include contact information, answers, selected products/options, estimated pricing, and configuration details. This information is provided to the manufacturer or workspace that owns the configurator.
Manufacturers are responsible for using lead data appropriately, responding to customers, and honoring any privacy, consent, or communication requirements that apply to their business.
Acceptable use
You may not use SmartSelect to upload unlawful, misleading, infringing, harmful, or abusive content; interfere with the service; attempt unauthorized access; misuse lead data; or use the service in a way that harms SmartSelect, other users, or third parties.
Intellectual property
SmartSelect and its software, design, and platform materials are owned by SmartSelect or its licensors. You retain ownership of your business content, product data, branding assets, and configurator materials.
You grant SmartSelect the limited rights needed to host, process, display, and transmit your content to provide the service.
Service availability
SmartSelect is provided on an as-is and as-available basis. We aim to operate a reliable service, but we do not guarantee uninterrupted availability, error-free operation, or that every issue will be resolved immediately.
No warranty and limitation of liability
To the fullest extent permitted by law, SmartSelect disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement. SmartSelect will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption.
SmartSelect's total liability for claims related to the service will be limited to the amount paid to SmartSelect for the service during the three months before the event giving rise to the claim, or USD $100 if no fees were paid.
Changes to these Terms
We may update these Terms as the product evolves. Updated Terms will be posted on this page, and continued use of SmartSelect after changes become effective means you accept the updated Terms.
