Lire en françaisTerms of Use
These terms govern use of the SmartSelect website and application, a guided selling service for manufacturers and their teams, and buyers’ use of their configurators.
Available features depend on the service version, your access and the third-party services enabled.
1. The service and sales handoff
SmartSelect is a service operated in Québec, Canada. In these terms, “SmartSelect”, “we” and “our” refer to this service and its operator. To contact the service operator, write to support@smartselect.dev.
SmartSelect helps manufacturers turn their catalog, website and expertise into product selection journeys, adjust them through conversation or editing, and receive structured requests. The manufacturer remains responsible for technical validation and commercial follow-up.
A recommendation, indicative price, quantity or configuration reference is not a firm offer, accepted quote or order. A SmartSelect subscription pays for software access, not the manufacturer’s products. The service does not guarantee technical or regulatory compliance, product availability or commercial results.
2. Accounts, workspaces and access
You must have authority to use the service for your business and provide accurate account information. Protect your credentials and promptly report unauthorized access.
Owners and administrators manage members and their roles. Reading, editing, publication, deletion, billing and third-party connections depend on the role and workspace access. Private conversations remain linked to their author; sharing a configurator in the workspace does not automatically expose chats to other members.
3. Your sources and configurator content
You retain your rights in your content. You must have the necessary permissions to upload documents and images, have a website analyzed or use third-party information. Do not provide secrets, credentials or sensitive information unnecessary for configuration.
You are responsible for published descriptions, questions, options, rules, compatibility, recommendations, visuals, brands, prices and references. Accepted file types and sizes are those shown in the application; file upload does not guarantee support for every document or spreadsheet.
4. AI assistance and human review
When AI is enabled, it may extract information, propose a configurator, ask for clarification, apply adjustments and provide contextual help. It can produce errors, omissions or incorrect interpretations. Check data, assumptions, incompatibilities and journeys before using them with buyers.
This assistance does not replace manufacturer expertise, professional advice or a safety assessment. A first version to try in minutes does not guarantee a launch time for every catalog or an exhaustive result. SmartSelect examples are fictional and do not validate your own products.
5. Discovery, retention and publication
You may start in a temporary session and try a private preview. Examples and the preview’s contact step simulate a request without real delivery. A session without an account has a limited lifetime; check that your work is saved in your account for durable retention.
Account creation, trial activation and publication are separate steps. Saving or editing a draft does not publish it. The buyer version changes after explicit publication; review the information and images that become accessible. The link depends on permissions, commercial access and active status.
Sharing prepares a link or message in the chosen channel; you select recipients and confirm sending. Copying a link or opening a messaging application does not prove receipt. Anyone with a public link may view its content while the link is available.
6. Free trial and work recovery
In the AI-assisted creation experience, an owner or administrator may activate a seven-day free trial once per workspace after saving and reviewing a configurator. The trial begins with explicit activation, without a card or automatic Stripe subscription. Starting or ending it causes no charge.
At expiry, public access is suspended without an active subscription. Work remains recoverable for thirty days after the trial. Guided recovery then requires an active subscription, without automatic deletion at that deadline. A voluntary subscription may restore the same published link without publishing private changes or restarting the trial.
7. Subscriptions and payment
The AI-assisted experience’s offer is presented with monthly billing in US dollars. The current price and terms are shown before subscribing; applicable taxes and the total are presented during payment. A preview or test amount does not itself enable a real purchase. Existing subscription terms remain those of that subscription until an explicitly applicable change.
Only your explicit subscription choice opens Stripe payment. A purchased subscription renews under the accepted terms until canceled. No automatic charge at trial expiry does not remove renewal of a voluntary subscription. Management and cancellation are available through Billing and the available portal; their effective date depends on the displayed terms.
The service must confirm payment or subscription status before restoring the relevant access. A browser return after payment is not confirmation. An interruption, unpaid invoice or cancellation may affect public access and related features.
8. Buyer requests, emails and CRM
A request may group several independent configurations, with quantities if enabled. The manufacturer is responsible for collected information, its privacy policy, required consents, recipients and follow-up communications. Incomplete configurations or matters requiring confirmation remain subject to its review.
Recording, emails and CRM synchronization are separate. A saved request may remain even if an email or CRM delivery fails. Check statuses and use available retry actions; SmartSelect does not guarantee third-party receipt or a manufacturer response time.
Third-party connections require your authorization and remain subject to providers’ offers, permissions and terms. Some connectors may be limited to testing or reading settings. A successful connection does not guarantee delivery or availability in every organization. Opportunities and their commercial status remain managed in the chosen CRM.
9. Offline use and deletion
Trade show mode may store a journey copy and requests on the device. A pending request is not yet saved on the server and triggers no external delivery. Protect the device, reconnect it and verify synchronization before clearing its data. The offline copy may need updating after publication.
Deleting a configurator removes its associated SmartSelect data and public access, with no restore action in the application. Emails, exports, offline copies and dossiers already received by third parties are not removed by that action. Trial expiry is not deletion. Contact support with account or data requests.
10. Acceptable use and intellectual property
Use SmartSelect lawfully. You may not publish misleading, unlawful, infringing or abusive content, misuse buyer contact information, bypass access controls, compromise security or disrupt the service.
SmartSelect’s software, interface and platform materials belong to SmartSelect or its licensors. You grant us the limited rights needed to host, process, analyze, display and transmit your content to provide the features used, including through providers described in the Privacy Policy. These rights do not transfer ownership of your documents, product data or brands.
For a public configurator, you also grant a limited, non-exclusive, royalty-free right to show screenshots or excerpts in private sales demonstrations and product education. This excludes private chats, source documents and buyer contact information. Using your company, logo or configurator as a public marketing reference, testimonial or case study requires separate approval.
11. Availability and liability
The service evolves and is provided as available. Maintenance, processing limits or outages, including at third parties, may interrupt a feature. We do not guarantee uninterrupted or error-free operation. Use that compromises security, third-party rights or these terms may lead to an appropriate access restriction.
To the extent permitted by applicable law, SmartSelect disclaims warranties of merchantability, fitness for a particular purpose and non-infringement, and liability for indirect, incidental, special, consequential or punitive damages, lost profits, revenue or data, and business interruption. Total liability related to the service is limited to fees paid during the three months preceding the event, or USD 100 if no fees were paid.
These exclusions and limits do not apply where prohibited by mandatory law and do not remove any right you cannot legally waive.
12. Privacy and changes to these terms
The Privacy Policy explains service-related processing. We display the revision date of these terms and communicate material changes appropriately before they apply where required. Continued use constitutes acceptance to the extent permitted by applicable law; separate consent remains necessary when required by law.
